RAILWAY SAFETY ACT: INPUT SOUGHT ON DRAFT REPLACEMENT REGULATIONS

The Department of Transport has gazetted four sets of draft regulations under the 2024 Railway Safety Act, which has been partially in force since August 2025. Stakeholders have until 30 August 2026 to comment.

Once finalised and operational, the proposed new regulations will repeal those in place under the 2002 Railway Safety Regulator Act dealing with:

• the development of railway safety standards (2022)
• railway safety permit fees (2015)
• notifiable railway occurrence categories and types (2022), and
• penalty fees (2011).
