RAILWAY SAFETY BILL SENT TO NCOP FOR CONCURRENCE

A ‘B’ version of the Railway Safety Bill has been passed by the National Assembly and sent to the NCOP for concurrence. According to a memorandum on its objects, among other things the Bill seeks to:

  • facilitate the role of operators in managing and implementing safety measures by:
    • addressing the ‘concerns raised over time’, and
    • removing ‘perceived conflicts of interest’, and to
  • strengthen the Railway Safety Regulator in ‘promoting safety and ensuring compliance’ with safety measures by providing for the introduction of:
    • ‘a framework of safety critical grades’ and safety management systems, and
    • a national railway safety information and monitoring system.

Once operationalised, the proposed new piece of legislation will repeal and replace the National Railway Safety Regulator Act, 2002.
