Al Jama-ah leader Ganief Hendricks' Registration of Muslim Marriages Bill has been tabled in the National Assembly. Its intention is to provide an interim solution to challenges associated with out-of-community marriages under Sharia law. According to a memorandum on the Bill's objects, it will take several years to introduce the legislative reforms necessary to remedy defects in the Divorce Act identified in a June 2022 Constitutional Court judgment. The Bill offers a 'bare bones' approach to addressing one of the key issues, which is registering Muslim marriages.
