RENEWABLE ENERGY: ENVIRONMENTAL AUTHORISATION REQUIREMENTS

Please note: On 6 December 2023, the Department of Forestry, Fisheries & the Environment issued a backdated media statement explaining that the required Eskom letter of consent should confirm that ‘the proposed layout of the facility will not unnecessarily obstruct access to the transmission or distribution infrastructure’.

‘A letter of consent from Eskom or its successor’ is required when applying for an environmental authorisation to develop a renewable energy facility within a certain radius of a main electricity distribution or transmission substation.

The Department of Forestry, Fisheries & the Environment has gazetted a notice confirming this, noting that the procedure is necessary to ensure ‘unrestricted access’ to the infrastructure concerned. The move follows a notice gazetted in July 2023 calling for input on what was envisaged at the time.
