RICA AMENDMENT BILL: NATIONAL ASSEMBLY COMMITTEE CALLS FOR SUBMISSIONS

In anticipation of parliamentary hearings on the Regulation of Interception of Communications & Provision of Communication-related Information Amendment Bill, the National Assembly’s Justice & Correctional Services Committee has called for written submissions by 6 October 2023. The notice concerned was posted on the Parliamentary Monitoring Group website on 15 September 2023 but, at the time of writing, had yet to be published by Parliament itself.

Tabled on 30 August 2023, the Bill seeks to respond to a September 2022 Constitutional Court judgment on the principal Act’s failure to provide ‘adequate safeguards’ to protect:

  • ‘the right to privacy, as buttressed by the rights of access to courts, freedom of expression and the media’, and
  • legal privilege.

To that end, its provisions include measures focusing expressly on practising lawyers and journalists under surveillance.
