ROAD ACCIDENT FUND ACT: DRAFT AMENDMENT BILL GAZETTED FOR COMMENT

The Department of Transport has called for input by 8 October 2023 on a draft Road Accident Fund Amendment Bill. According to a memorandum on the Bill’s objects, it seeks to:

  • ‘further limit the liability of the Fund’
  • ‘improve the solvency and sustainability of the scheme’, and
  • ‘ensure a more equitable distribution of the risk assumed by the Fund, the private insurance industry, and other stakeholders’.

This is noting that a Road Accident Benefit Scheme Bill tabled in 2017 was withdrawn following recommendations from the National Assembly’s Transport Committee at the time that ‘amendments to the Act may be more prudent’.

The process of amending the Act and regulations began in 2021. Informed by the legal opinions of ‘various Senior Counsels’ on ‘potential amendments’ that would ‘assist the … (fund) in achieving its objectives’.
