Please note: On 10 December 2024 both the Railway Safety Act and the National Road Traffic Amendment Act were gazetted. Neither is in force.
The 2021 Railway Safety Bill and 2020 National Road Traffic Amendment Bill have been signed into law, according to recent Presidency media statements. However, at the time of writing neither Act had been gazetted.
Once in force, the Railway Safety Act is expected to improve freight and passenger safety – among other things by assigning the management and implementation of safety measures to the operators themselves. This will enable the rail safety regulator to focus on promoting safety and monitoring compliance, according to a memorandum on the Railway Safety Bill’s objects.
Once operationalised, the National Road Traffic Amendment Act is expected to facilitate the effective implementation of interventions highlighted in the 2016-2030 National Road Safety Strategy and address practical challenges. This is according to a memorandum on the objects of the Bill concerned. To that end, among other things the new piece of legislation:
