SCRAP METAL: PRICE PREFERENCE SYSTEM UNDER REVIEW

The International Trade Administration Commission (ITAC) has been instructed to investigate the merits or otherwise of modifying the scrap metal, ferrous and non-ferrous waste price preference system (PPS). This is according to a notice gazetted by the Department of Trade, Industry & Competition, which – in addition to issuing the necessary directive – summarises its underpinning rationale.

As SA Legal Academy has regularly reported, introduced in 2012 the PPS:

  • makes scrap and other metal waste available to local mills and manufacturers at a discount
  • was intended to discourage the export of scrap and other metal waste metal that could be locally beneficiated, and
  • now stands at the international benchmark price less 30%.

However, in the light of ‘alleged challenges … faced by the integrated steel value chain’ and related issues, the 30% discount may require modification.

While the notice does commit the ITAC to a robust stakeholder consultation process, at this stage a call for input has yet to be published and a deadline set.
