SENIOR COUNSEL & ATTORNEY HONOURS: CONFERRAL GUIDELINES AMENDED

The Department of Justice & Constitutional Development has gazetted an amendment to its March 2024 uniform guidelines on recommending the conferment of senior counsel or senior attorney honours on an eligible legal practitioner.

Affecting the composition of the committee appointed by the Legal Practice Council to consider and process nominations, the amendment is nevertheless somewhat confusing. Clarity is needed.

This notwithstanding, as SA Legal Academy reported in March 2024, the guidelines are underpinned by principles set out in a preamble to the 2014 Legal Practice Act. Among other things, these require that – in making recommendations to the Minister – the Council should:

  • ‘facilitate the realisation of the goal of a transformed and restructured legal profession that is accountable, efficient and transparent’, and
  • enhance and maintain the integrity and status of the legal profession.
