SMALL CLAIMS COURTS: NEW RULES IN FORCE

New rules for the Small Claims Courts came into effect on 1 April 2023, when those in place since 1985 were repealed. Justice & Constitutional Development Minister John Jeffrey confirmed this during his address at a recent long service awards function in Durban.

Gazetted in October 2022, ‘the new rules provide for new procedures’ and require new forms to be used … (and) new responsibilities … placed on clerks and functionaries of the Small Claims Courts’.
