STATISTICS ACT: DRAFT AMENDMENT BILL GAZETTED

A draft Statistics Amendment Bill has been gazetted – possibly in lieu of the explanatory summary procedurally required before a Bill is formally tabled in Parliament.

According to a memorandum on the Bill’s objects, once enacted and operationalised the proposed new piece of legislation is expected to ‘strengthen co-ordination and enhance collaboration amongst data producers and data users by creating an enabling environment for the production and consumption of quality statistics’.

Approved by Cabinet in October 2022, the Bill also seeks to rectify aspects of the principal statute in conflict with 22 pieces of domestic legislation. In that context, a Statistics SA presentation in September 2023 to the National Assembly’s Planning, Monitoring & Evaluation Committee notes three:

  • the ‘Deeds Act’ (Deeds Registries Act, 1937, as amended)
  • the Tax Administration Act, 2011, as amended, and
  • the ‘Educators Act’ (possibly referring to the Employment of Educators Act, 1998). Unfortunately, no further details are provided.

Neither is it clear when the draft Bill was submitted to Parliament. In that regard, the presentation refers to May 2023. However, parliamentary papers reflecting the titles of draft Bills submitted for information and planning purposes and those formally tabled during May make no mention of it.

Once operationalised, the proposed new piece of legislation will enable the authorities concerned to proceed with the development and implementation of:

  • a ‘national statistics system’, comprising is ‘an ensemble of statistical organisations and units … responsible for the joint collection, processing and dissemination of official and other statistics’, and
  • a ‘national strategy for the development of statistics’.
