The Rules Board for Courts of Law has called for comments by 30 June 2023 on the possible removal of ‘colour photographs’ and ‘photographs’ from the list items not to be contained in the appeal record.
This is according to a notice posted on the Department of Justice & Constitutional Development website, which refers to a mismatch between Supreme Court of Appeal Rule 8 sub-rule (6)(j) and Rule 9 sub-rule (a).
Having considered the matter, the Rules Board’s view is that ‘photographs are always necessary for the proper determination of an appeal and that experience has shown that the appeal judges require them.’ This is given that Rule 9 sub-rule (a) permits the inclusion of colour photos ‘by agreement’.
