SUPREME COURT RULES: HEADS OF ARGUMENT

The Department of Justice & Constitutional Development has called for comments by 29 September 2023 on draft amendments to Supreme Court of Appeal Rule 10, dealing with heads of argument.

Affecting subrules 10 (3)(f) and (4)(b), the Rules Board for Courts of Law has proposed that the supporting documentation and annexures to heads of argument should each be bound separately, regardless of volume. This is noting that the ‘heads of argument bundle’ should comprise only the heads themselves, the list of authorities and the chronology.
