THREE KEY BILLS READY TO BE SIGNED INTO LAW

Parliamentary papers and a related media statement have confirmed that, on 6 December 2023, the NCOP passed three key pieces of legislation, which have now been sent to the President for signature.

They are:

  • the National Health Insurance Bill’s ‘B’ version (the overarching objective of which is to establish a fund from which health care services for all registered users will be purchased)
  • the Regulation of Interception of Communications & Provision of Communication-Related Information Amendment Bill’s ‘B’ version (giving effect to a 2021 Constitutional Court ruling on adequate safeguards where the subject of surveillance is a practising journalist or lawyer), and
  • the Judicial Matters Amendment Bill’s ‘B’ version (addressing a host of issues, including the property-related status of existing customary law marriages).

Interestingly, the latest progress report on implementing State Capture Commission recommendations notes the significance of provisions in the Judicial Matters Amendment Bill strengthening the Prevention & Combating of Corrupt Activities Act by criminalising the ‘failure to prevent bribery’.
