TOBACCO BILL: NEDLAC SOCIAL PARTNERS TO BE ‘SUBSTANTIALLY’ CONSULTED

The National Economic Development & Labour Council (NEDLAC) has initiated a process for government’s social partners to be ‘substantially consulted’ on the Tobacco Products & Electronic Delivery Systems Control Bill. This is according to a media statement issued by the National Assembly’s Health Committee – among other things confirming that the NEDLAC report emerging from this process will be considered with all other submissions on the Bill. Meanwhile, the committee will continue with its nationwide public hearings programme.

The committee announcement followed an earlier statement prompted by an opinion from Parliament’s acting chief law adviser on the legality of a public participation process undertaken by the previous committee under the sixth Parliament. As SA Legal Academy has already reported, at the time the committee was ‘satisfied’ that the Department of Health had fulfilled its pre-tabling consultation obligations regarding legislation underpinned by significant policy changes.

As SA Legal Academy has regularly reported, among other things the Bill seeks to:

  • make indoor public places and certain outdoor areas 100% smoke-free
  • ban the sale of cigarettes through vending machines
  • make plain packaging with graphic health warnings and pictorials mandatory
  • ban the display of tobacco products at points-of-sale, and
  • include electronic nicotine delivery systems and non-nicotine delivery systems in the regulation and control of tobacco products.
