TOBACCO PRODUCTS & ELECTRONIC DELIVERY SYSTEMS CONTROL BILL TABLED

Tabled in Parliament in draft form on 2 November 2022, the Tobacco Products & Electronic Delivery Systems Control Bill was formally introduced on 9 December and is now available. According to a memorandum on its objects, once operationalised the Bill will strengthen public health protection measures, aligning South Africa’s legislation with the World Health Organisation Framework Convention on Tobacco Control requirements.

To that end, the Bill provides for ministerial determinations that could see all indoor public places and certain outdoor areas declared 100% smoke-free. Other provisions ban cigarette vending machines and point-of-sale product display; and introduce mandatory plain packaging with graphic health warnings and pictorials. In addition, the Bill paves the way for the regulation and control of electronic nicotine and non-nicotine systems delivery systems.

The Tobacco Control Act, 1993, will be repealed once the Bill has been passed, enacted and commenced.
