TRADITIONAL & KHOI-SAN LEADERSHIP BILL: PARLIAMENTARY COMMITTEE CALLS FOR SUBMISSIONS

The National Assembly’s Co-operative Governance & Traditional Affairs Committee has called for written submissions by 14 August 2026 on the Traditional & Khoi-San Leadership Bill. Once passed, enacted and operationalised, this proposed new piece of legislation will replace the 2019 Traditional & Khoi-San Leadership Act – which, in May 2023, the Constitutional Court declared invalid on the grounds of insufficient public participation. The deadline for remedying this has already been extended.

As SA Legal Academy recently reported, the Bill seeks to:

  • provide for the recognition of Khoi-San communities, leaders and structures
  • ‘ensure an integrated approach in dealing with all matters relating to traditional and Khoi-San affairs’, and
  • facilitate countrywide uniformity in dealing with such matters.
