TRADITIONAL & KHOI-SAN LEADERSHIP BILL SUBMITTED TO PARLIAMENT

The Department of Co-operative Governance & Traditional Affairs submitted a draft Traditional & Khoi-San Leadership Bill to Parliament within hours of gazetting the procedurally required explanatory summary on 27 February 2028. This is according to parliamentary papers published the same day.

Not yet certified by the Office of the State Law Adviser, the draft Bill was submitted for information purposes only with the aim of enabling the committees concerned to factor it into their work programmes. Once certified and formally tabled, the Bill will be made public.

Seeking to ‘consolidate’ the 2003 Traditional Leadership and Governance Framework and 2009 National House of Traditional Leaders Act, the proposed new piece of legislation also provides for the recognition of Khoi-San kingships/queenships, Khoi-San communities and their leaders.

Released in November 2024 for public comment, the Bill responds to a May 2023 Constitutional Court ruling on inadequate public participation during the passage through Parliament of a Bill subsequently enacted and repealed. In November 2024, the Court postponed to May 2027 the deadline for passing legislation remedying this – as SA Legal Academy reported at the time.
