TRANSKEIAN PENAL CODE REPEAL BILL TABLED IN PARLIAMENT

Once in force, the Bill will reinstate common-law rules, crimes and defences abolished in 1983 by a code specifically applicable to the area formerly known as the Republic of Transkei. This is according to a memorandum on the Bill’s objects. Tabled in the National Assembly shortly before Parliament went into recess for this year’s festive season, the Bill was approved by Cabinet on 1 December 2022. At the time, a media statement on the meeting noted the Bill’s significance in the context of government’s commitment to a unitary judicial system and moves afoot to deal appropriately with the ‘continued existence of apartheid-era legislation’.
