The Transport Appeal Tribunal Amendment Bill (passed by Parliament in December 2024) has been signed into law and the new statute gazetted. However, it is not yet in force.
It is now almost five years since the Bill concerned was tabled in Parliament with the aim of addressing ‘problems’ and ‘issues’ experienced by the tribunal since its establishment in 1998 – at least, according to a memorandum on the Bill’s objects. Presumably, these difficulties continue unabated.
As things now stand, the tribunal is responsible for ‘dealing with appeals related to applications for public road carrier permits (now called operating licences) and cross-border or cabotage permits’. Prior to the tribunal’s establishment, these functions were performed by the National Transport Commission.
