TRANSPORT APPEAL TRIBUNAL: INPUT SOUGHT ON DRAFT REPLACEMENT REGULATIONS

Please note: 1) On 17 May 2024 a notice was gazetted calling for public comments on a new set of draft regulations, possibly informed by input received on the earlier version. 2) On 18 August 2026, the 2024 Transport Appeals Tribunal Amendment Act came into force, as reported here. There having been no further developments at a regulatory level, presumably the 2013 regulations still apply.

The Department of Transport has called for input by 13 August 2023 on Transport Appeal Tribunal draft regulations intended to replace those in force since 2013.

In the absence of a statement from the department or its Minister, it is not clear why the existing regulations cannot be amended rather than replaced. A line-by-line comparison is therefore required to identify material changes. In that regard, several new definitions point to the possibility of substantive amendments.
