UNIFORM COURT RULES: PARTY AND PARTY RECOVERY TARIFF STRUCTURE TO BE AMENDED?

The Rules Board for Courts of Law has called for input by 30 August 2024 on proposed amendments to sub-rule (5)(b) of Uniform Rule 70, which prescribes factors to be considered when calculating the fees charged for certain services. This is noting that the sub-rule:
- was not updated in 1996, when a ‘new tariff structure for party and party recovery for attorneys’ was introduced, and
- still refers to tariff items that either:
- no longer exist, or
- from which no departure is permitted.
