UPSTREAM PETROLEUM RESOURCES DEVELOPMENT BILL READY FOR NCOP

Please note: On 21 September 2023 (24 hours after the committee report on the Bill was tabled) its ‘B’ version was published on the Parliamentary Montoring Group website. It incorporates changes agreed and adopted by the committee, which are reflected in an ‘A’ list also published on the site.   

The National Assembly’s Mineral Resources & Energy Committee has tabled a report in the House recommending unspecified changes to the Upstream Petroleum Resources Development Bill. Parliamentary Monitoring Group records of meetings at which these were discussed tend to suggest they may be substantive. Unfortunately, however, at the time of writing the ‘A’ list reflecting changes agreed and adopted by the committee was not available. No details are included in a backdated committee media statement published after the report was tabled.

Tabled in July 2021, the Bill’s overarching objective is to create an independent piece of legislation for the upstream petroleum sector – removing all related provisions from the Mineral & Petroleum Resources Development Act, 2002, which will then focus entirely on mineral resources.

Once passed by the House, a ‘B’ version of the Bill incorporating changes proposed by the committee will be sent to the NCOP for concurrence. As a section 76 piece of legislation affecting the provinces, it will be the focus of more hearings as part of the mandatory public participation process required of each legislature.
