WASTE MANAGEMENT: DRAFT EXCLUSION-RELATED REGULATIONS OUT FOR COMMENT

The Department of Forestry, Fisheries & the Environment has gazetted draft amendments to regulations under the 2008 National Environmental Management: Waste Act affecting the procedures followed when considering applications for the exclusion of a waste stream or portion thereof from the definition of waste. Input is sought by 4 May 2025.

Once in force, the amendments envisaged will:

  • replace provisions prescribing:
    • the criteria to be met when applying for an exclusion, and
    • conditions in which the authorities may consider such applications
  • set out the procedures to be followed when registering a trial with possible waste stream exclusion in mind, and
  • replace provisions prescribing:
    • the elements of a risk assessment report
    • risk management plan contents
    • reporting requirements
    • the transfer, variation, revocation, suspension and surrender of an exclusion authorisation, and
    • offences and penalties.
