The Department of Forestry, Fisheries & the Environment has gazetted draft amendments to regulations under the 2008 National Environmental Management: Waste Act affecting the procedures followed when considering applications for the exclusion of a waste stream or portion thereof from the definition of waste. Once in force, the amendments envisaged will:

- the criteria to be met when applying for an exclusion, and
- conditions in which the authorities may consider such applications
- set out the procedures to be followed when registering a trial with possible waste stream exclusion in mind, and
- replace provisions prescribing:
- the elements of a risk assessment report
- risk management plan contents
- reporting requirements
- the transfer, variation, revocation, suspension and surrender of an exclusion authorisation, and
- offences and penalties.
