WASTE MANAGEMENT: INPUT SOUGHT ON EXTENDED PRODUCER RESPONSIBILITY FEE GUIDELINES

The Department of Forestry, Fisheries & the Environment has called for input by 3 March 2024 on draft guidelines for determining extended producer responsibility fees payable in terms of regulations in place since November 2020 under the National Environmental Management: Waste Act, 2008.

According to an executive summary of the draft guidelines and associated and tool kit proposals, their primary objective is to assist producer responsibility organisations and individual producers implementing extended producer responsibility schemes in their efforts to comply with Regulation 7, which deals with financial arrangements.

This is noting:

  • government policy on a producer’s obligations during the post-consumer phase of a product’s life cycle
  • the ‘user pays principle’ underpinning that policy, the intention of which is to incentivise sustainable waste management practices in a ‘resource efficient and circular economy’, and that.
  • the November 2020 regulations (amended in January and May 2021).
