WASTE MANAGEMENT LICENSING GAPS TO BE CLOSED

The Department of Forestry, Fisheries & the Environment has gazetted a notice announcing its intention to impose waste management licensing requirements on the operators of facilities:

  • holding waste disposal permits issued under the 1989 Environment Conservation Act
  • established to dispose of waste before that Act came into force, and
  • established before the Act came into force and since compliant with February 2002 regulations for general communal and small waste disposal sites.

This is noting that most sections of the Environment Conservation Act were repealed and replaced by the National Environmental Management: Waste Act, 2008.

Against that backdrop, input is sought by 30 November 2024 on:

  • a proposal allowing two years for affected waste disposal facility operators to apply for waste management licences, and
  • draft licensing regulations on the procedures to be followed.
