WATER INFRASTRUCTURE AGENCY ACT: END IN SIGHT FOR TECHNICAL ERROR BILL

The NCOP Committee on Co-operative Governance & Public Administration (including traditional affairs, human settlements, water and sanitation) has called for written submissions by 9 March 2026 on a South African National Water Resources Infrastructure Agency SOC Ltd Amendment Bill correcting a technical error in the principal statute.

Once passed by Parliament, enacted and commenced, the amendment concerned will fully operationalise the 2024 South African National Water Resources Infrastructure Agency SOC Ltd Act by providing for:

  • the agency’s listing as a major public entity in Schedule 2 to the 1999 Public Finance Management Act, and
  • the delisting of the Trans-Caledon Tunnel Authority from the same schedule.

Tabled in April 2025, passed by the National Assembly five months later and immediately referred to the NCOP for concurrence. It is not clear why the committee responsible for finalising the parliamentary process has taken so long to do so. This is bearing in mind that – except for one provision affected by the error – the principal statute has been in force since 7 February 2025.
