WATER RESOURCES INFRASTRUCTURE AGENCY BILL: FINAL OPPORTUNITY FOR INPUT

Written submissions are sought by 7 May 2024 on a ‘B’ version of the South African National Water Resources Infrastructure Agency SOC Ltd Bill, which is now before the NCOP Committee on Co-operative Governance & Traditional Affairs, Water & Sanitation and Human Settlements.

Tabled in August 2023, the Bill’s overarching objective is to separate policy development and regulatory responsibilities from infrastructure management. To that end, it seeks to establish a national water resources infrastructure agency as a new state-owned company – with governance matters vested in its board and the rights of the state exercised by the Minister of Water & Sanitation. This is noting:

  • ‘an emerging recognition of the need for a stronger public sector in the key area of infrastructure development, effective maintenance, operation and management … to support social and economic development’, and that
  • the Department of Water & Sanitation ‘cannot raise capital directly on the financial markets and is reliant on special-purpose vehicles’ to fund and implement ‘viable economic projects’.
