WATER RESOURCES INFRASTRUCTURE AGENCY BILL: PURPOSE AND OBJECTIVES

Tabled in Parliament on 25 August 2023, the South African National Water Resources Infrastructure Agency SOC Ltd Bill’s overarching objective is to ‘separate the policy development and regulatory responsibilities of the Department of Water & Sanitation – as custodian of national water resources infrastructure – from its infrastructure management-related development and implementation responsibilities.

According to a memorandum on the Bill’s objects, this will create a vehicle for raising capital ‘directly on the financial markets’ for the ‘development, operation and maintenance of national water resources infrastructure’. As things now stand, the department ‘is reliant on special-purpose vehicles’, and in particular the Trans-Caledon Tunnel Authority, to finance and implement ‘viable economic projects’.

The Bill therefore provides for the authority’s disestablishment and ‘the transfer of all its assets, liabilities, rights, obligations, powers, treaty and non-treaty functions as a going concern’ into the proposed new agency. All national government waterworks will also be transferred.
