WHISTLEBLOWING: LEGISLATIVE REFORM DISCUSSION DOCUMENT OUT FOR COMMENT

The Department of Justice & Constitutional Development has called for input by 15 August 2023 on a discussion document exploring reforms to the prevailing legislative framework on whistleblowing. It includes a table of possible amendments to the Protected Disclosures Act, 2000, and Witness Protection Act, 1998.

According to a media statement on the document, it:

  • builds on President Cyril Ramphosa’s response to Zondo Commission findings and recommendations
  • is underpinned by ‘thorough research and (a) comparative analysis of whistleblower systems’ in various developed countries with ‘established frameworks’ as well as those in several African states.
  • recognises the importance of ensuring that whistleblowers receive the ‘necessary legal and emotional assistance to help them navigate ... (a) complicated legal system and deal with the emotional challenges that come with it’, and
  • proposes interventions intended to ‘encourage accountability and transparency, and inspire more people to speak up against fraud and corruption’.
