WILD ABALONE: TWO SETS OF DRAFT REGULATIONS OUT FOR COMMENT

The Department of Forestry, Fisheries & the Environment has called for input by 16 March 2025 on two sets of draft regulations affecting wild abalone.

Once finalised, one set of proposed new regulations would apply only to the Eastern Cape – allocating abalone to the small-scale fishing sector. In terms of section 18 of the 1998 Marine Living Resources Act, it is envisaged that – for abalone to be included in the basket of permissible species for small-scale fishing rights holder harvesting – the delegated authority would set a total allowable catch/‘effort’ of 28.5 tonnes.

The other set comprises proposed amendments to regulations on the protection of wild abalone under the same Act. Released in draft form in July 2023 for public comment, the amendments now envisaged incorporate some of the input received. It is now proposed that the restriction on scuba diving operations envisaged at the time would apply to a smaller area of the Suiderstrand.
