AARTO ACT: MUNICIPALITY-SPECIFIC COMMENCEMENT DATES GAZETTED

Two recently gazetted presidential proclamations have announced the 1 July 2026 commencement of certain sections of the 1998 Administrative Adjudication of Road Traffic Offences Act and its 2019 amending legislation. This follows the December 2025 withdrawal of presidential commencement proclamations published in August 2025, on which SA Legal Academy reported at the time.
According to both proclamations, schedules identifying municipalities to which the commencement date applies are underpinned by:
- section 12 of the 1998 Local Government: Municipal Structures Act, and
- section sub-section 2(2) of the 2005 Cross-boundary Municipalities Repeal & Related Matters Act.
It is not clear why, since these provisions deal with the allocation of seats on a municipal council.
