COMMUNICATION COSTS: BUNDLE ROLL-OVER & TRANSFER REGULATORY UPDATE

The Independent Communications Authority of South (ICASA) is finalising draft amendments to end user and subscriber service charter regulations intended to provide for ‘standardisation in the application of … (bundle) roll-over and transfer by licensees’. This is according to a media statement issued by the National Assembly Committee on Trade, Industry & Competition following a meeting on ‘the cost and expiration of data’. Released in February 2024 for public comment (as SA Legal Academy reported at the time), the amended regulations are expected to be gazetted in November 2025.

An ICASA presentation document circulated at the meeting included a section on the amendments envisaged – among other things noting that:

  • the amended regulations 8A and 8B will clarify and expand upon rules affecting data, voice, and small message system (SMS) services expiry, roll over and transfer
  • the prevailing regulations are ‘not in line with international best practices’
  • ‘aim to enhance the monitoring and enforcement of customer care standards’, and that
  • the amended expiry rules ‘aim to contribute to the protection of end-users from losing the financial value of unused data, voice and SMS minutes, with an option of transferring same to other end-users of their choice to enhance value creation’.
