CONSTITUTIONAL DEMOCRACY PROTECTION ACT IN FORCE

The Protection of Constitutional Democracy Against Terrorist & Related Activities Amendment Act came into effect on 5 December 2023 by presidential proclamation in the Government Gazette. It is one of two pieces of legislation developed in response to international Financial Action Task Force (FATF) concerns about shortcomings in South Africa’s anti-terrorism laws. The other is the General Laws (Anti Money Laundering & Combating Terrorism Financing) Amendment Act, most sections of which came into force on 31 December 2022, as SA Legal Academy has already reported. Identified by the FATF in October 2021, if not addressed by 1 April 2023 these shortcomings could see South Africa grey listed.
