EMPLOYMENT EQUITY AMENDMENT ACT GAZETTED BUT NOT YET IN FORCE

The Employment Equity Amendment Act, 2022, has been gazetted but is not yet in force. According to the Act’s section 16 (short title and commencement), it will take effect on a date to be announced in the Government Gazette.

As SA Legal Academy has already reported, the Employment Equity Amendment Bill’s ‘B’ version was signed into law on 12 April 2023 – having been passed by Parliament in May 2022.

Once operationalised, among other things the new piece of legislation will empower the Minister to:

  • set employment equity targets for economic sectors and regions, and
  • regulate the compliance criteria to be met when tendering for state contracts.
