Parliamentary papers have confirmed that a Mine Health & Safety Amendment Bill in the pipeline for several years has finally been tabled in Parliament. Released in draft form in June 2022 for public comment, the Bill’s revised, uncertified version was submitted to Parliament in October 2024 for planning and information purposes only – as SA Legal Academy reported at the time. This followed the Government Gazette’s publication of a procedurally required pre-tabling summary. It is not clear why the Office of the Chief State Law Adviser took 18 months to certify the Bill for formal introduction and processing.
According to a memorandum on the objects of the proposed new piece of legislation, among other things it addresses anomalies with the aim of ensuring that the principal statute is consistent not only with the prescripts of the 2002 Mineral & Petroleum Resources Development Act but also with the requirements of other relevant legislation.
