POLITICAL PARTY FUNDING ACT REGULATIONS: INPUT SOUGHT ON DRAFT AMENDMENTS

The Electoral Commission has called for input by 12 November 2024 on draft amendments to regulations under the Political Party Funding Act, 2018. They were gazetted as draft regulations under the Electoral Matters Amendment Act, 2024 – which made material changes to the Political Party Funding Act, as SA Legal Academy has regularly reported.

Among other things, the draft amendments spell out the obligations of accounting officers managing the financial interests of:

  • parties not represented in the National Assembly or a provincial legislature
  • parties newly elected to one or more of those institutions and not previously represented in any of them, and
  • independent candidates and representatives.

This is with particular attention to donations (including those from foreign entities), membership fees/levies (in the case of political parties), loans received and any other income sources.

The draft regulations include references to donation and disclosure thresholds, which are the focus of a parliamentary process now under way with the aim of giving effect to a Western Cape High Court ruling handed down in August 2024.
